Question
We have paid the lawyer 700 dollars, so far. We still owe 400, but can't save up the money to pay it. It is a chapter 7. Will we get the 700 back since nothing has happened yet, or will he keep that? What is the general rule I guess is what I'm asking?
Answer
It depends on the agreement that you have with your attorney. Do you have a written agreement? What does it say? Attorneys should provide clients with a written agreement outlining the attorney's fees, what work is covered by those fees, when they are due, etc. In the law office for which I worked, clients who were making payments in advance and decided not to file bankruptcy would be charged the attorney's hourly fee for any work already performed.
