It depends on the agreement that you have with your attorney. Do you have a written agreement? What does it say? Attorneys should provide clients with a written agreement outlining the attorney's fees, what work is covered by those fees, when they are due, etc. In the law office for which I worked, clients who were making payments in advance and decided not to file bankruptcy would be charged the attorney's hourly fee for any work already performed. The rest of the amount on deposit would be refunded.
