Question
They have filed a civil action in court against me. After our bankruptcy case was discharged in Dec. It's May. According to my research this violates Sec 524 of Bankruptcy code. And do I have the right to sue them for harassment and my attorney's fees'? HELP? Yes it was put in the bankruptcy, and my lawyer sucks,he just wants to refer me to another lawyer after he soaked me for 1400.00. Should I get another lawyer.
Answer
depends if the mortgage was part of the bankruptcy. if they agreed to take the payments then NO they can not now come after you for more. you should really call the person who did the bankruptcy for you and ask them. however i know my husband did not include the house in his as his X-wife got the house. have fun.
