Can a bankruptcy trustee go after a home? | |

Question
john and sally get divorced. sally gets the house but owes john 1/2 of what is owed on the home. John files for bankruptcy. Sally has not paid John the $. Can the bankruptcy trustee force sally to sell the home to pay what is owed to john?
Answer
It depends on the laws in that state. For the most part, the answer is yes, unless she can remortgage the home and pay his half or convince the bank to assign the entire debt to her. Regardless of his bankruptcy status, she still has to uphold the conditions of the divorce. Permalink:
